TERMS & CONDITIONS

Our understanding and agreement to the following terms and conditions of use are acknowledged:

â¢ Lessee hereby agrees to take care with the Wiener Wagon, and save it from harm which may be under Lesseeâs control, and following use thereof, agree to clean the unit and properly dispose of any refuse and/or trash, and to return the unit to VFSB in as good condition as received;

â¢ Lessee further agrees to indemnify VFSB for any loss, costs or clean-up or other costs associated with their lease and/or use of the Wiener Wagon which may accrue to VFSB;

â¢ Lessee hereby acknowledges that they have received instruction in the safe use of the Wiener Wagon and the equipment contained therein, and has inspected that unit and stipulates that all is in good working condition and free from hazard under proper use;

â¢ Lessee hereby agrees that they will not hold VFSB, its officers, agents and/or employees, liable for any loss, injury, bodily injury, property damage or theft that Lessee or any invitees, employees, agents, or persons working with Lessee, sustain or suffer while leasing the Wiener Wagon;

â¢ Lessee hereby agrees that at such times as the Wiener Wagon is being towed to and from its use destination, the towing vehicle and towing equipment will be of appropriate size and power to safely and properly tow the trailer, and further that the owner of the towing vehicle will be liable for any injury or damage sustained by a third party resulting from the tow;

â¢ Lessee hereby understands and agrees that they are solely responsible for any liability incurred while the Wiener Wagon is in their care, custody and control and/or due to their use of the Wiener Wagon and that they will provide VFSB with a Certificate of Insurance certifying General Liability Insurance coverage, Bodily Injury and Property Damage, in an amount not less than $1 million per occurrence and Vehicle Liability Insurance coverage in an amount not less than $500,000 Combined Single Limit, Bodily Injury and Property Damage, and further Lessee agrees to name VFSB as Additional Insured for both General Liability and Vehicle Liability;

â¢ Lessee hereby understands and agrees to be legally bound for themselves, their heirs, executors, administrators and assigns, and will hold harmless, indemnify, & defend VFSB, its officers, agents and/or employees and will waive and release any and all rights and claims for loss against VFSB, its officers, agents and/or employees;

â¢ I certify by my signature that this entire Agreement, including all terms and conditions specified herein, are binding upon the entire organization represented, as if all officers, members, associates, volunteers and others have signed their acknowledgement and agreement hereto.
